City extends parent elections but doesn’t heed calls to start over

Under pressure from elected officials and organized parents, the Department of Education is delaying elections for district parent councils until next week.

For weeks, parent leaders have been simmering with anger over problems in the city’s handling of elections for district Community Education Councils. They have charged that the city did too little to recruit candidates, turned away some eligible parents, and hid the names of candidates behind password protection.

The criticism escalated today, as Manhattan Borough President Scott Stringer and Public Advocate Bill de Blasio announced plans for a press conference Tuesday to demand that the city halt the elections, which they called “deeply flawed and undemocratic.” At the same time, a group of parents, spearheaded by Mona Davids of the New York City Parents Union, filed today for a restraining order to halt the elections.

This afternoon, the city announced it would delay the election proceedings by a week. “After reviewing concerns raised by parents and public officials about this year’s Citywide and Community Education Council elections, I have concluded that the process could and should have been handled better,” Chancellor Dennis Walcott said in a statement. Borough president asks city to redo “flawed” parent elections

Following complaints from parents about this year’s council elections, Manhattan Borough President Scott Stringer is calling on the city to postpone the elections for a second time.

Calling the process “badly flawed,” Stringer said that a series of mistakes made by the Department of Education’s Office of Family Information and Action had undermined parents’ confidence in the elections for members of the Community Education Councils. In a letter sent to Chancellor Dennis Walcott, Stringer asked that the city redo the elections.

Walcott responded that the elections would take place, as planned, on May 7.

“I cannot stress enough the importance of parent involvement in our schools and the Office for Family Information and Action will take all necessary steps to ensure that all of our parents have an opportunity to cast a vote in the CEC elections by May 7th,” the chancellor said in a statement. Renewed mayoral control has a parent council rethinking its role

Nothing in the renewed mayoral control legislation that passed yesterday altered the role of district parent councils, but that hasn’t stopped one council president from starting to rethink his role under the new system.

Jim Devor, president of the Community Education Council in Brooklyn’s District 15, said that the renewed attention to parental involvement and a new parent training center offer parent councils the chance to redefine themselves. Many council members around the city have felt marginalized and have a strained relationship with the city education department. According to Devor, the councils could now become “conduits” between the Department of Education, the training center and parent associations and parent-led School Leadership Teams.

“We could see ourselves as the barefoot doctors for parent training,” Devor said.

Devor said that CEC members should be among the first to avail themselves of the training the new center will provide and can then reach out to their parents and schools and effectually pay the training forward.

Little is known yet about the details of the $1.6 million dollar parent training center created in the mayoral control re-authorization bill. The legislation calls for the center, which will be operated by the City University of New York, to train parents in all five boroughs on how to effectively work both in their schools and also on the district- and city-wide levels. The center will also assist parents in communicating with teachers, school administrators and Department of Education offices. The legislation additionally mandates that the center will “conduct outreach and recruitment” to increase the diversity of parent-led council and leadership teams in schools and districts.

Given the new center’s as-yet vague mission and relatively small budget, Devor said he suspects it will be difficult for the new training center to make deep inroads with parents on the ground level throughout the city.  The already-established parent councils could act as arms to assist in distributing the center’s training message to parents throughout their districts.

Community Education Councils are officially charged with evaluating district superintendents, approving district zoning plans and reviewing their district’s capital plans.

Parent councils sent resolutions on a road to nowhere

Over the course of the last year, an elected parent council passed four resolutions, but the Department of Education never got them.

The Community Education Council in District 1 sent each of the resolutions to staff members at the Office of Family Engagement and Advocacy and then waited for a response. For council members, the resolutions, which are non-binding, are their main avenue for talking to the chancellor. Now the Office says that it never received the resolutions because the CEC didn’t follow the correct protocol for submitting them.

“No resolutions were received from CEC 1 last year,” wrote Martine Guerrier, who heads the Office of Family Engagement and Advocacy, in an email to council member Lisa Donlan yesterday.

The communication breakdown between the two bodies is not an isolated incident. Several councils said they’ve never received a single response to the resolutions they’ve passed, confirming for many members the sense that the city is ignoring them. At the same time, the Office says that parent councils have disregarded the system set up specifically to handle their resolutions.

Jim Devor, a member of the CEC in district 15, said he first learned that his council’s resolution had been declined when he read it on GothamSchools on July 9. Four days later, the DOE still had not contacted the council with its decision, he said.

“Common civility would have dictated a formal reply actually directed to the Council and/or its members,” Devor wrote in a strongly worded email to Klein. He added that the lack of response reflected “a thinly veiled contempt” for the council. (more…)

To serve on new Board of Ed, deputy mayors needed waivers

The newly reconstituted Board of Education is stacked with three deputy mayors — but before the officials could serve on the board, they had to get waivers from Mayor Bloomberg.

That’s because of a statute in the city charter that prevents people from holding two city jobs without receiving a waiver from the mayor. Bloomberg wrote letters (read them here) authorizing Patricia Harris, his first deputy mayor; Dennis Walcott, his deputy mayor for education; and Ed Skyler, his deputy for operations to serve on the Board of Education on the same day that it met for the first time in seven years.

A deputy mayor sat on the school board as recently as the Giuliani administration, when Giuliani appointed a board member, Ninfa Segarra, as his deputy mayor. But it’s not clear to me whether three deputy mayors have ever served on the board simultaneously. (Knowledgeable readers?)

In each letter, Bloomberg explains he is waiving the prohibition because the deputy mayors won’t be compensated for their service on the board. (State law outlines $15,000 salaries for board members and $20,000 salaries for the board president, but all board members right now are waiving the salaries.) Bloomberg appointed two of the deputies to the board, Harris and Skyler. The Queens borough president, Helen Marshall, appointed Walcott, who is now president of the board.

DOE dashes a CEC’s hopes of turning into a school board

When members of a parent council requested to become a community school board last week, they knew it was an unlikely proposition. A Department of Education lawyer has confirmed their suspicions.

The DOE’s general counsel, Michael Best, denied the Community Education Council for District 1′s request in an e-mail, writing that under the pre-2002 law there is “no provision for the Chancellor to appoint the CEC to act as a community school board.”

CEC president Lisa Donlan said she was “really disappointed” but not surprised by the DOE’s decision. “My guess is if they wanted to make us act like school boards and follow the law, they could.”

Donlan and other council members held a meeting on July 1 to tackle the central problem facing CEC members: Under the current law, their group no longer legally exists. Wishing to become a legally recognized body, they voted to request that Chancellor Joel Klein appoint them to a community school board. These boards existed before mayoral control and had significantly more power than the CECs do.

Instead, the Department of Education is planning to continue the Community Education Councils. Best’s e-mail urges the CEC to keep meeting over the summer.

Best’s e-mail (below) also, amusingly, refers to the provisions of “the old law.” As of July 1, it’s current law. (more…)

Klein urges CECs to keep meeting, though they don’t legally exist

A day after mayoral control’s expiration, the Board of Education has been resurrected, but there are no signs of life for community school boards.

Instead, the Department of Education is planning to continue the Community Education Councils — despite the fact that they no longer legally exist. These parent councils replaced school boards in 2003 and, with the law’s expiration, have been legally stripped of their authority and responsibilities.

Chancellor Joel Klein, who was voted back into office unanimously today by the new Board of Education, sent a memo to principals today outlining his plans for the CECs. He said he is urging the CECs to continue meeting “at least until September when we hope to have more clarity.”

“If the Councils decide not to continue their work, we’ve asked them to notify us immediately,” Klein wrote.

The decision to create of a Board of Education and vote in a chancellor while leaving the rest of the power structure as it was under mayoral control has divided the system into old and new. The school system’s top half is in compliance with pre-2002 law, while its lower quarters legally don’t exist. (more…)

Lawsuit seeks to reverse multiple school zoning decisions

Elected parent leaders in Manhattan are asking the city to reverse multiple school decisions, including ones that the city has used to manage severe overcrowding in many neighborhood schools, because they say they should have been involved in making the decisions. The demand comes in a lawsuit filed yesterday, the second in three months against the Department of Education over its adherence to state law that requires parent groups to be consulted before some decisions are made.

Members of the Community Education Council for District 2, which includes the Upper East Side and most of Manhattan below Central Park, say the city violated the law by not consulting them when it made decisions about opening and closing schools and how students were assigned to district schools. With the city teachers union, they filed a lawsuit yesterday over about a dozen cases in recent years where the DOE failed to consult the CEC about major zoning changes (one case dates back to 2001).

The suit details the ways council members say the DOE brusquely informed them of its “unilateral” decisions after they had been made. Among them:

  • The parent council learned about the closing of Bayard Rustin High School in Chelsea by looking at the DOE’s Web site, parents allege.
  • It learned of the opening of another school via an e-mail from DOE official John White: “Good morning. Please see new addition of Quest to Learn School.” (more…)

To kindergarten shutouts, top schools official says, “I’m sorry”

Anyone who stayed until the bitter end of a three-hour meeting last night about kindergarten waitlists in Manhattan got a surprise: an uncharacteristic apology from a top DOE official.

Hundreds of parents turned out for a meeting of the parent council for District 2 to vent about having been shut out, at least for now, of their neighborhood schools. Last week, Manhattan parents protested at City Hall after 273 children were put on waiting lists at many elementary schools.

Deputy Chancellor Kathleen Grimm arrived late to the meeting after spending her afternoon dealing with the swine flu outbreak in Queens. She sat quietly in the audience and listened to a tense back and forth between school officials and angry parents. The auditorium had mostly emptied and council members were preparing to adjourn when Grimm approached the microphone to make a surprise statement, which I captured on video above. Here’s a key part of what she said:

I also want to say something that I thought I heard people from the DOE say tonight, but just in case you didn’t, I want to say, I’m sorry. We’re sorry. We have stumbled on some of this planning.

The two officials leading the meeting told parents during the meeting that most schools should be able to eliminate their wait lists by the middle of June, after families find out where they’ve been offered seats in gifted and talented programs. John White, who heads the Department of Education’s efforts to manage school space, said that more children in each area qualified for gifted admissions than there are children on the waiting list. A proposal to empower parent councils by transforming them

Lots of people nod at the idea that the biggest failing of mayoral control of the public schools has been a lack of parent involvement. The president of Manhattan, Scott Stringer, this week issued a proposal that lays out a roadmap he argues would change that.

Rather than re-thinking the citywide education board, as other advocates have done, Stringer’s proposal targets the elected parent councils that already exist. His idea is to inject gravity and authority into the councils, which are now beset by pitifully low participation rates and a reputation for powerlessness, by taking a hint from the real-estate and development world.

In that world, groups of citizen volunteers called community boards work together to develop responses to proposals from developers and policy makers on everything from whether to tear down a building to concerns about dog excrement. City Hall can’t make a decision without at least collecting a board’s formal response.

The idea is gaining some headway; Assemblyman Jeffrey Dinowitz of Brooklyn intends to introduce a bill that would formally propose the idea to the legislature in the next few days. (more…)
