Has this ruling taken away the right for a teacher to file a complaint with the NYS Human Rights Commission?

Given the Court’s ‘reasoning’, the carve out for public school districts would NOT apply to Charter Schools. In NYC, at least, this would result, at least hypothetically, in similar protection for both sets of students. Interesting.

Federal courts applying state law apply state law precedent — i.e., a federal court would apply this decision and dismiss the case on the pleadings.

This will have to go before the federal court. New York has a distinction for being both corrupt and fascist.
